Can You Handle the Truth? Conducting Effective Workplace Investigations
The strength of an employer’s defense of harassment, discrimination, and retaliation claims comes from its complaint resolution process and the effectiveness of its workplace investigations into those complaints. Being able to recognize a complaint that warrants an investigation is critical, as is the ability to conduct an investigation in a timely, effective, objective, and meaningful manner. Where do you start, who should be interviewed, what should a report include, and what if you can't decide what really happened? Should you do the inquiry in-house or engage a neutral third-party investigator? You've got questions, the lawyer has answers! You don’t have to be Columbo, Inspector Cluso, or a private investigator to investigate well, but there are certain key best practices and pro tips to know before venturing out in search of the "truth". Join us for this entertaining, engaging, and highly informative program as we dive into the depths of workplace investigations.
LEARNING OBJECTIVES:
1. Review different levels of legal risk associated with claims of harassment, discrimination, and retaliation, and explore how an effective workplace investigation will serve your risk management goals.
2. Learn the difference between harassment and bullying in a legal context and when an investigation might be warranted in those situations.
3. Explore real world scenarios involving harassment, bullying, and other inappropriate workplace behaviors.
4. Review steps and strategies for conducting an effective workplace investigation, including learning when, who, and how to interview, what to document, and how to close the loop once the inquiry is completed.
